The research aims, through a bibliographical analysis, to demonstrate the importance of urban occupations in the city's flow. It proposes a counterpoint between a brief history of legislation on private property combined with historical factors and the formation of cities. It drives criticism of public policies adopted for urban planning and how they support the migration process and formation of the periphery. Thus, the work assumes that the city is a space of struggle for the effectiveness of rights combined with the capital process. One of the greatest capitalist expressions is private property, as it exerts a great influence on the class struggle, on the gentrification process and on the construction of the subjective identity of the being through ethnic-cultural identification and social interaction. Finally, the aim is to highlight the culture and public entertainment that, for the most part, occur in urban centers and that exclude specific audiences, such as those from occupations. This group, through occupation, can play an important role in the city's dynamics and can contribute to the opening of spaces for artistic expressions. This questioning should go beyond housing, as it is much more about who has the right to the city and urban life and what the right to a “roof” can provide.
