SYSTEMATIC MAPPING OF RULES ON ADMINISTRATIVE SANCTIONS IN BIDDING CONTRACTS OF THE AIRFORCE COMMAND

Initiating an Administrative Process for the Investigation of Irregularities (PAAI) in the face of companies hired by the Brazilian Air Force (FAB) is of utmost important since it aims to restrain criminal practices on the behalf of bidders and contractors during the bidding process. This research aims to systematically map and organize knowledge on the standards that deal with administrative sanctions in bidding contracts within the scope of the Aeronautics Command (COMAER), besides showing the existing gaps in laws and regulations. Regulatory gaps may provoke legal uncertainty toward administrative procedures, as well as bring about unreasonable and disproportionate decision-making. Thus, the study aims to understand the sanctioning process in administrative contracts and demonstrate its relevance toward preserving the public interest and using it as an instrument for cultural change. Therefore, stemming from the literature review, it is possible to identify regulatory gaps regarding administrative sanctions. Hence, strategies will be developed to improve the sentencing guidelines in administrative contracts within the scope of the Air Force Command, aiming to mitigate subjectivity in the implementation of sanctions.
