SUMMARY:

The Brazilian state presents alarming data on gender violence and thousands of girls and women are constantly attacked. They are victims of various forms of offense, such as sexual, and for a matter of minutes, their bodies are violated, suffering the crime of rape. In 2013, Law nº 12,845, known as the Next Minute Law, came into force, an important public policy instrument for emergency, comprehensive and multidisciplinary care for people in situations of sexual violence. Because it is a policy to promote human achievement and the realization of the fundamental right to health, it must be implemented universally. Bearing in mind this scenario, the present research aims to analyze whether girls and women victims of rape have access to an emergency doctor, provided for in the aforementioned norm, in an equal manner, regardless of socioeconomic factors, in hospitals that are part of the Unified System. of Health in the state of Minas Gerais. This territorial delimitation was necessary due to the fact that Brazil is a very extensive and diverse country, with Minas Gerais being an interesting entity due to the large number of municipalities and economic, social and cultural diversity. For this purpose, microdata from the Notifiable Diseases Information System (SINAN) were used from 2013 to 2021, using descriptive statistics tools. It was found that factors such as color, education, age, the victim's region of residence, the relationship between the victim and the aggressor, and the year the crime was recorded had an impact on access to emergency medical care. Victims who are black, illiterate or with incomplete primary education, minors, residents of regions with lower GDP shares and low MHDIs, and with a known offender, are less likely to undergo emergency procedures after the rape. As if that were not enough, the lack of social effectiveness of the Next Minute Law is also observed, since, from its validity until 2021, there was a decrease in the number of medical consultations.
