This research will analyze how John Rawls' philosophy, specifically his conception of justice expressed in his theory of justice as equity, is associated with the right to education. Given the importance of education in the development of citizens for their participation in political life and construction of a just society, we can associate it with a conception of justice, and this research will adopt the one theorized by Rawls. Considering the historical process of affirming the fundamental right to education and considering the constitutional process as the result of a social agreement, it can be said that society constitutionalized it because it considers it fair that citizens have that right. Thus, the research will analyze the associations between Rawls' theory of justice and the right to education.
